Agreement to Terms
These Terms of Service ("Terms") govern your access to and use of the Inkable Docs website, applications, and related services (collectively, the "Service") made available by Inkable Docs LLC ("Inkable Docs," "we," "us," or "our").
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. You may use the Service only if you are at least 13 years old and legally capable of entering into a binding contract in your jurisdiction. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization.
Description of Service
Inkable Docs provides tools to analyze and improve the accessibility of PDF documents, including but not limited to:
- PDF/UA compliance assessments
- Accessibility report generation and analytics
- Matterhorn Protocol checks
- WCAG compliance assessments and related checks
The Service may include web applications, APIs, integrations with third-party platforms, and optional AI-powered features that assist with accessibility analysis and remediation. We may update, improve, or modify the Service from time to time, including by adding or removing features.
Accounts and Security
To access certain features of the Service, you may be required to create an account and provide certain information (such as an email address). You agree to:
- Provide accurate, current, and complete account information
- Maintain and promptly update your information as needed
- Maintain the security and confidentiality of your login credentials
- Notify us promptly of any unauthorized access or use of your account
- Accept responsibility for all activities that occur under your account
We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.
Fees and Payment
The Service may be offered on free, trial, and paid subscription plans. We describe applicable fees and plan features on our website or within the Service.
If you subscribe to a paid plan, you authorize us (or our payment processor, such as Stripe) to charge the applicable subscription fees and any related taxes using your selected payment method. Unless otherwise stated, subscriptions automatically renew at the end of each billing period at the then-current rate until you cancel.
You may cancel your subscription at any time as described in the Service; cancellation will take effect at the end of the then-current billing period. Except where required by law or explicitly stated otherwise, all fees are non-refundable.
We may change our fees or introduce new charges with reasonable advance notice. Fee changes will apply beginning with the next billing period after the effective date of the change. Your continued use of the paid Service after a fee change takes effect constitutes your agreement to the new fees.
Acceptable Use
You agree to use the Service only in a lawful manner and in compliance with these Terms and all applicable laws and regulations. You may not:
- Use the Service in any way that violates any applicable law or regulation
- Upload, submit, or process documents or content that you do not have the right to use or that infringe any third party's rights
- Attempt to gain unauthorized access to the Service or related systems
- Interfere with or disrupt the integrity or performance of the Service
- Use automated means (including bots, scripts, or scrapers) to access the Service in a manner that burdens or interferes with normal operations
- Reverse engineer, decompile, or disassemble the Service, except where permitted by law
- Use the Service to build or improve a competing product or service
- Share, resell, or transfer your account without our prior written consent
We may suspend or terminate your access to the Service if we reasonably believe you have violated this Acceptable Use section.
Documents and Content
You may upload or otherwise submit PDF documents and related content ("Documents") to the Service for analysis and remediation. You retain all ownership rights in and to your Documents, subject to the limited license granted below.
- You grant Inkable Docs a limited, worldwide, non-exclusive, royalty-free license to use, process, store, and reproduce your Documents solely as necessary to provide and improve the Service, generate reports, maintain and secure the Service, and comply with legal obligations.
- Our intention is not to retain your full Documents after processing is complete, except as may be temporarily necessary for backup, security, or legal compliance.
- We may retain non-identifying or aggregated data derived from your use of the Service (such as metrics, statistics, and anonymized accessibility findings) to improve the Service.
- You are solely responsible for ensuring you have all necessary rights and permissions to upload and process your Documents using the Service.

AI and Automated Processing
The Service may use automated systems and AI models (including models provided by third-party AI providers) to analyze Documents, generate accessibility findings, and suggest remediations.
We use such systems solely to provide and improve the Service. We impose contractual restrictions on our AI providers prohibiting them from using your Documents to train their generalized models, to the extent we control such processing. For more information, please see our Privacy Policy.
Intellectual Property
The Service, including all software, algorithms, user interfaces, designs, documentation, and other content (excluding your Documents), is owned by Inkable Docs and its licensors and is protected by intellectual property laws.
Subject to your compliance with these Terms and any applicable plan limitations, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your internal business or personal purposes. You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part thereof, except as expressly permitted by us in writing.
If you submit ideas, suggestions, or feedback about the Service ("Feedback"), you grant us a perpetual, irrevocable, worldwide, non-exclusive, royalty-free license to use, copy, modify, and exploit the Feedback for any purpose, without restriction or compensation to you.
Third-Party Services
The Service may integrate or interoperate with third-party services, platforms, or tools (such as authentication providers, payment processors, hosting providers, or AI services). Your use of any third-party services is subject to the terms and privacy policies of those providers, and we are not responsible for their acts or omissions.
We may change or discontinue integrations with third-party services at any time.
Beta Features
We may provide access to features or functionality that are identified as beta, preview, or experimental ("Beta Features"). Beta Features are provided for evaluation and testing only, may be subject to additional terms, and may be modified or discontinued at any time. Beta Features are provided "as is" without any warranties and may be less reliable or accurate than other parts of the Service.
Service Availability and Modifications
We strive to operate the Service with high availability, but we do not guarantee that the Service will be uninterrupted or error-free. We may:
- Perform scheduled or unscheduled maintenance
- Modify or discontinue any part of the Service
- Impose or adjust usage, storage, or rate limits
Where reasonably practicable, we will provide notice of material changes to the Service.
Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," AND WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, uninterrupted, secure, or that it will meet your requirements. The results of any accessibility analyses, checks, or reports are provided for informational purposes only and do not constitute legal advice or a certification of compliance with any particular law, standard, or regulation.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- IN NO EVENT WILL INKABLE DOCS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (I) THE AMOUNTS YOU HAVE PAID TO INKABLE DOCS FOR THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (II) ONE HUNDRED U.S. DOLLARS (US $100) IF YOU HAVE NOT PAID ANY AMOUNTS.
Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.
Indemnification
You agree to indemnify, defend, and hold harmless Inkable Docs and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of the Service
- Your Documents or any content you submit
- Your violation of these Terms
- Your violation of any rights of another person or entity
Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Service will be governed by and construed in accordance with the laws of the State of Wyoming, U.S.A., without regard to its conflict of laws principles.
- You and Inkable Docs agree to submit to the exclusive jurisdiction of the state and federal courts located in the State of Wyoming for the resolution of any dispute arising out of or relating to these Terms or the Service, and you waive any objection to venue in such courts.
- To the extent permitted by law, you and Inkable Docs agree that any claims must be brought in your individual capacity and not as a plaintiff or class member in any purported class, collective, or representative action.
- You and Inkable Docs each waive any right to a jury trial in any judicial proceeding arising out of or related to these Terms or the Service.
Some users may have additional rights or protections under the laws of their jurisdiction; these Terms are not intended to limit any non-waivable rights.
International Users
The Service is operated from the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. For users in the European Economic Area (EEA), the United Kingdom, or other regions with data protection laws, our processing of personal data is described in more detail in our Privacy Policy. Mandatory consumer protections in those jurisdictions may apply in addition to these Terms.
Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice by posting the updated Terms on our website and updating the "Last updated" date above, and we may also notify you by email or through the Service. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Service.
Miscellaneous
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. You may not assign or transfer these Terms or your rights or obligations hereunder, in whole or in part, without our prior written consent. We may assign these Terms without restriction. These Terms constitute the entire agreement between you and Inkable Docs with respect to the Service and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral, relating to the Service.
Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
